§ 1
GENERAL PROVISIONS
1. glavini Shop operates on the basis of the principles set out in these Regulations.
2. The Regulations set out the conditions for the conclusion and termination of Sales Agreements for Products and the procedure for complaints, as well as types and scope of services provided electronically by the glavini Shop the rules for the provision of these services, the conditions for the conclusion and termination of agreements for the provision of services electronically.
3.. Each Customer, as soon as he or she undertakes activities aimed at using the Electronic Services of the galvini store, is obliged to comply with the provisions of these Regulations.
4. In matters not covered by these Regulations, the provisions of:
4.1. the Act on Provision of Electronic Services of July 18, 2002 (Journal of Laws No. 144, item 1204 as amended),
4.2. the Act on Consumer Rights of May 30, 2014. (Journal of Laws 2014 item 827),
4.3. Act on out-of-court resolution of consumer disputes of September 23, 2016. (Journal of Laws 2016 item 1823),
4.4. Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93 as amended) and other relevant provisions of Polish law.
§ 2
DEFINITIONS CONTAINED IN THE REGULATIONS
1. FORMULARZ REJESTRACJI – formularz dostępny na stronie internetowej www.galvini.pl , www.galvini.eu , www.galvini.de umożliwiający utworzenie Konta.
2. FORMULARZ ZAMÓWIENIA – formularz dostępny na stronie internetowej www.galvini.pl , www.galvini.eu , www.galvini.de umożliwiający złożenie Zamówienia.
3. KLIENT – Usługobiorca będący Konsumentem, który zamierza zawrzeć lub zawarł Umowę Sprzedaży ze Sprzedawcą.
4. KONSUMENT – osoba fizyczna, która dokonuje z przedsiębiorcą czynności prawnej niezwiązanej bezpośrednio z jej działalnością gospodarczą lub zawodową.
5. KONTO – oznaczony indywidualną nazwą (loginem) oraz hasłem, zbiór zasobów w systemie teleinformatycznym Usługodawcy, w którym gromadzone są dane Usługobiorcy w tym informacje o złożonych Zamówieniach.
6. NEWSLETTER – Usługa Elektroniczna pozwalająca Usługobiorcy na subskrybowanie i otrzymywanie na podany przez Usługobiorcę adres e-mail bezpłatnych informacji pochodzących od Usługodawcy, dotyczących Produktów dostępnych w Sklepie.
7. PRODUKT – dostępna w Sklepie rzecz ruchoma albo usługa, będąca przedmiotem Umowy Sprzedaży między Klientem a Sprzedawcą.
8. REGULAMIN – niniejszy regulamin Sklepu.
9. SKLEP – Sklep internetowy Usługodawcy działający pod adresem www.galvini.pl , www.galvini.eu , www.galvini.de
10. SPRZEDAWCA, USŁUGODAWCA – GALVINI Mateusz Augustyn wpisaną do Centralnej Ewidencji i Informacji o Działalności Gospodarczej Rzeczypospolitej Polskiej prowadzonej przez ministra właściwego do spraw gospodarki, adres siedziby: 45B Kwiatowa St., 38-300 Gorlice , place of business and address for service: 45B Kwiatowa St., 38-300 Gorlice, NIP:7382146633, REGON: 123160234, electronic mail address (e-mail): kontakt@galvini.pl, galvini@galvini.eu phone number: +48 505-287-100.
11. SALE AGREEMENT – Product Sales Agreement concluded between the Customer and the Seller through the Store.
12. ELECTRONIC SERVICE – service provided electronically by the Service Provider to the Customer through the Store.
13. USER – a natural person, a legal person or an organizational unit without legal personality, which is granted legal capacity by the law, using the Electronic Service.
14. ORDER – Customer’s declaration of intent constituting an offer to conclude a Sales Agreement for the Product with the Seller.
§ 3
INFORMATION ON PRODUCTS AND THEIR ORDERING
1. The Shop www.galvini.pl , www.galvini.eu , www.galvini.de conducts retail sales of Products via the Internet, exclusively to Consumers.
2. Products offered in the Shop are new, free from physical and legal defects and have been legally introduced into the Polish market.
3. The information contained on the websites of the Shop does not constitute an offer within the meaning of the law. The Customer, by placing an Order, makes an offer to purchase a specific Product under the conditions specified in its description.
4. The price of the product shown on the Store’s website is given in net amounts in currencies such as the Polish zloty (PLN) euro (EUR) and the U.S. dollar (USD). The price does not include delivery costs. For companies buying in Poland, VAT will be added to the net amounts.
5. The price of the Product shown on the Shop website is binding at the moment of placing the Order by the Customer. This price will not change regardless of price changes in the Store that may occur for individual Products after the Customer places an Order.
6 Orders can be placed through the website using the Order Form (Shop www.galvini.pl , www.galvini.eu , www.galvini.de ) – 24 hours a day all year round.
7 In order to place an Order, the Customer is not required to register an Account with the Store.
(8) The condition for placing an Order in the Store by the Customer is to read the Terms and Conditions and accept their provisions at the time of placing the Order.
9.The Store processes orders placed from Monday to Friday during the working hours of the Store, i.e. from 8:00 to 16:00 on working days. Orders placed on working days after 12:00 , on Saturdays, Sundays and holidays, will be processed on the next working day.
10. Products on promotion (sale) have a limited number of pieces and Orders for them will be processed in the order of their receipt until the stocks of a given Product are exhausted.
§ 4
CONCLUSION OF THE SALES CONTRACT
1) In order to conclude the Sales Agreement, it is necessary for the Customer to previously submit the Order by means made available by the Seller, in accordance with § 3 item 6 and 8.
2. After submitting the Order, the Seller immediately confirms its receipt.
3. Confirmation of acceptance of the Order for execution binds the Customer to his/her Order. Confirmation of receipt and acceptance of the Order for execution takes place by sending an e-mail message.
4. Confirmation of acceptance of the Order for execution includes:
4.1. confirmation of all essential elements of the Order,
4.2. withdrawal form,
4.3. these Regulations containing instructions on the right to withdraw from the contract.
5.As soon as the Customer receives the e-mail message referred to in item 4, a Sales Agreement is concluded between the Customer and the Seller.
6. Each Sales Agreement will be confirmed by a proof of purchase (invoice), which will be attached to the Product.
§ 5
METHODS OF PAYMENT
1. the Seller provides the following payment methods:
1.1. payment by traditional transfer to the Seller’s bank account,
2. payments in the store are made by traditional transfer to the bank account.

In the title of the transfer, please write “Order No……..”. or the name of the company.
(3) The customer shall pay the price of the Sales Agreement within 7 working days from the date of its conclusion.
§ 6
COST, TIMING AND DELIVERY METHODS OF THE PRODUCT
1) The cost of delivery of the product is determined during the ordering process and depends on the choice of the product and the country of delivery.
2) The term of delivery of the product consists of the time of completion of the product and the time of delivery of the product by the carrier:
2.1) The time of completion of the Product is 7 working days from the moment of acceptance of the order for processing by the Seller.
2.2) The time of completion of the out-of-stock product is 15 working days from the moment of acceptance of the order for processing by the Seller.
2.3) Delivery of the Product by the carrier takes place within the time declared by the carrier. Approximate waiting time is given after placing the order.
(3) The Customer, including the Customer from outside Poland, may pick up the Product in person by prior arrangement by phone or e-mail.
§ 7
PRODUCT COMPLAINT
1 Warranty claim.
1.1. Wszystkie Produkty oferowane w Sklepie posiadają gwarancję producenta i obowiązują na terenie Unii Europejskiej.
1.2. Okres gwarancji dla Produktów wynosi 24 miesiące i jest liczony od dnia dostarczenia Produktu do Klienta.
1.3. Dokumentem uprawniającym do ochrony gwarancyjnej jest dowód zakupu.
1.4. Gwarancja nie wyłącza uprawnień Konsumenta wynikających z rękojmi za wady fizyczne i prawne Produktu, określone w Kodeksie cywilnym.
2. Reklamacja z tytułu rękojmi.
2.1. Podstawa i zakres odpowiedzialności Sprzedawcy wobec Klienta będącego Konsumentem, z tytułu rękojmi obejmującej wady fizyczne i prawne, są określone w ustawie Kodeks cywilny z dnia 23 kwietnia 1964 r. (Dz. U. nr 16, poz. 93 ze zm.).\
2.2. Zawiadomienia o wadach dotyczących Produktu oraz zgłoszenie odpowiedniego żądania można dokonać za pośrednictwem poczty elektronicznej na adres: kontakt@galvini.pl , galvini@galvini.eu lub pisemnie na adres:

2.3. In the above message in written or electronic form, please provide as much information and circumstances regarding the subject of the complaint as possible, in particular the type and date of the irregularity and contact information. The information provided will greatly facilitate and expedite the processing of the complaint by the Seller.
2.4. For the assessment of physical defects of the Product, it should be delivered to the address:

2.5. Sprzedawca ustosunkuje się do żądania Klienta niezwłocznie, nie później niż w terminie 14 dni od momentu zgłoszenia reklamacji.
2.6. W przypadku reklamacji Klienta będącego Konsumentem – nierozpatrzenie reklamacji w terminie 14 dni od jej zgłoszenia jest jednoznaczne z jej uwzględnieniem. W związku z uzasadnioną reklamacją Klienta będącego Konsumentem Sprzedawca pokrywa koszty odbioru, dostawy wymiany Produktu na wolny od wad.
2.7. Odpowiedź na reklamację jest przekazywana Konsumentowi na papierze lub innym trwałym nośniku.
§ 8
RIGHT OF WITHDRAWAL
(1) Subject to point 10 of this paragraph, a Customer who is also a Consumer who has concluded a contract at a distance, may withdraw from the contract without giving reasons by making a statement to that effect within 14 days. To meet this deadline it is sufficient to send a statement of withdrawal provided by the Store.
2. To exercise the right of withdrawal, the Consumer must inform us, GALVINI Mateusz Augustyn, delivery address: 45B Kwiatowa St., 38-300 Gorlice, electronic mail address (e-mail): kontakt@galvini.pl, phone number: +48 505 287 100 , about his decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by mail, or by e-mail). The Consumer may use the model withdrawal form, but it is not mandatory.
3. In order to comply with the deadline for withdrawal, it is sufficient for the Consumer to send information on the exercise of his right of withdrawal before the expiry of the deadline for withdrawal.
4In the event of withdrawal from the contract, the Sales Agreement is considered not concluded, and the Consumer is obliged to return the Product to the Seller or give it to a person authorized by the Seller to collect it immediately, but no later than 14 days from the day on which he withdrew from the contract, unless the Seller offered to collect the Product himself. To meet the deadline it is sufficient to return the Product before its expiration.
5. In case of withdrawal from the Sales Agreement, the Product should be returned to the address:

(6) The consumer shall be liable for any diminution in the value of the Product resulting from use beyond what is necessary to ascertain the nature, characteristics and functioning of the Product.
(7) Subject to points 8 and 10 of this paragraph, the Seller shall refund the value of the Product plus the cost of delivery using the same method of payment used by the Consumer, unless the Consumer has expressly agreed to a different method of return that does not incur any costs for him.
(8) If the Consumer has chosen a method of delivery of the Product other than the cheapest ordinary method of delivery offered by the Store, the Seller shall not be obliged to reimburse the Consumer for the additional costs incurred by the Consumer.
(9) If the Seller has not offered to collect the Product from the Consumer himself, the Seller may withhold reimbursement of the payment received from the Consumer until he receives the item back or the Consumer provides proof of its return, whichever event occurs first.
(10) A consumer withdrawing from the Sales Agreement, in accordance with Section 1 of this paragraph, shall bear only the cost of returning the Product to the Seller.
(11) The fourteen-day period within which the Consumer may withdraw from the contract shall be counted from the day on which the Consumer took possession of the Product, and in the case of services from the date of conclusion of the contract.
12th The right of withdrawal from the contract concluded remotely does not apply to the Consumer in the case of a Sales Agreement:
12.1 in which the subject of performance is a non-refabricated item, produced to the Consumer’s specifications or used to meet his individualized needs.
12.2 in which the subject of performance is an item supplied in a sealed package, which after opening the package cannot be returned for health protection or hygienic reasons, if the package has been opened after delivery,
12.3 in which the subject of performance is an item that after delivery, due to its nature, is inseparably combined with other items,
12.4 in which the subject of performance is a service, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the start of performance that after the performance by the Seller will lose the right to withdraw from the contract.
13 The right of withdrawal from the Sales Agreement shall be vested in both the Seller and the Customer (Consumer), in case of failure of the other party to the agreement to perform its obligation within a strictly defined period.
14 According to the applicable law, the right of withdrawal has only the consumer. A consumer is a natural person making a purchase of products not directly related to his/her professional or business activity.
§ 9
TYPE AND SCOPE OF ELECTRONIC SERVICES
1. Service Provider allows through the Store to use Electronic Services such as:
1.1. concluding Product Sales Agreements,
1.2. maintaining an Account in the Store,
1.3. Newsletter.
2. Provision of Electronic Services to Service Recipients in the Store takes place under the conditions specified in the Regulations.
3. Service Provider has the right to post advertising content on the Store website. This content, is an integral part of the Store and the materials presented therein.
§ 10
TERMS AND CONDITIONS FOR THE PROVISION AND CONCLUSION OF CONTRACTS FOR THE PROVISION OF ELECTRONIC SERVICES
1. provision of Electronic Services specified in § 10.1 of the Terms and Conditions by the Service Provider is free of charge.
2. the period for which the agreement is concluded:
2.1. agreement for the provision of Electronic Services consisting of maintaining an Account in the Store is concluded for an indefinite period.
2..2. agreement for the provision of Electronic Services consisting of placing an Order in the Store is concluded for an indefinite period of time and is terminated at the time of placing the Order or ceasing to place it by the Customer.
2.3. agreement for the provision of Electronic Services consisting of using the Newsletter is concluded for an indefinite period of time.
3Technical requirements necessary to cooperate with the ICT system used by the Service Provider:
3.1. computer (or mobile device) with access to the Internet,
3.2. access to e-mail,
3.3. web browser,
3.4. enable Cookies and Javascript in the web browser.
4.The Customer is obliged to use the Shop in a manner consistent with the law and morality, taking into account respect for personal property and intellectual property rights of third parties.
5. The Customer is obliged to enter data in accordance with the facts.
6. The Customer is prohibited to provide unlawful content.
§ 11
COMPLAINTS RELATED TO THE PROVISION OF ELECTRONIC SERVICES
(1) Complaints related to the provision of Electronic Services through the Store, the Customer may submit via e-mail to: kontakt@galvini.pl or galvini@galvini.eu .
(2) In the above email, please provide as much information and circumstances regarding the subject of the complaint as possible, in particular the type and date of the irregularity and contact information. The information provided will greatly facilitate and expedite the processing of the complaint by
Service Provider.
3. The Service Provider’s processing of the complaint shall be carried out immediately, no later than within 14 days from the moment of notification.
4. The Service Provider’s response to the complaint shall be sent to the e-mail address of the Client provided in the complaint notification or in any other manner provided by the Client.
§ 12
TERMS AND CONDITIONS OF TERMINATION OF CONTRACTS FOR THE PROVISION OF ELECTRONIC SERVICES
1 Termination of the agreement for the provision of Electronic Services:
1.1 The agreement for the provision of Electronic Services of a continuous and indefinite nature (e.g. maintaining an Account) may be terminated.
1.2 The Customer may terminate the agreement with immediate effect and without indicating reasons by sending an appropriate statement via e-mail to: kontakt@galvini.pl or galvini@galvini.eu .
1.3. Usługodawca może wypowiedzieć umowę o świadczenie Usługi Elektronicznej o charakterze ciągłym i bezterminowym w przypadku, gdy Usługobiorca narusza Regulamin, w szczególności, gdy dostarcza treści o charakterze bezprawnym po bezskutecznym wcześniejszym wezwaniu do zaprzestania naruszeń z wyznaczeniem odpowiedniego terminu. Umowa w takim wypadku wygasa po upływie 7 dni od dnia złożenia oświadczenia woli o jej wypowiedzeniu (okres wypowiedzenia).
1.4. Wypowiedzenie prowadzi do ustania stosunku prawnego ze skutkiem na przyszłość.
2. Usługodawca i Usługobiorca mogą rozwiązać umowę o świadczenie Usługi Elektronicznej w każdym czasie w drodze porozumienia stron.
§ 13
INTELLECTUAL PROPERTY
(1) All content on the website at www.galvini.pl , www.galvini.eu , www.galvini.de enjoys copyright protection and (subject to § 13.3 and elements used under license, transfer of copyright or permitted use)is the property of the GALVINI Mateusz Augustyn , Kwiatowa street 45B , 38-300 Gorlice
NIP: 7382146633 The recipient shall be fully liable for any damage caused to the Service Provider resulting from the use of any content of www.galvini.pl , www.galvini.eu , www.galvini.de , without the consent of the Service Provider.
(2) Any use by anyone, without the express written consent of the Service Provider, of any of the elements comprising the content and the content of the website www.galvini.pl , www.galvini.eu , www.galvini.de shall constitute an infringement of copyright vested in the Service Provider and shall result in civil and criminal liability.
(3) All trade names, Product names, company names and their logos used on the Store’s website at www.galvini.pl , www.galvini.eu , www.galvini.de belong to their respective owners and are used for identification purposes only. They may be registered trademarks. All materials, descriptions and images presented on the Store’s website at www.galvini.pl , www.galvini.eu , www.galvini.de are used for informational purposes.
§ 14
FINAL PROVISIONS
(1) Contracts concluded through the Shop are concluded in accordance with Polish law.
(2) In the event of any part of the Regulations being inconsistent with applicable law, the relevant provisions of Polish law shall apply in place of the disputed provision of the Regulations.
(3) Any disputes arising from Sales Contracts between the Shop and Consumers will be resolved in the first instance by negotiation, with the intention of settling the dispute amicably, taking into account the Act on out-of-court settlement of consumer disputes. However, if this would not be possible, or would be unsatisfactory to either party, disputes will be resolved by the competent court of general jurisdiction, in accordance with Section 4 of this paragraph.
4Judicial settlement of disputes:
4.1 Any disputes arising between the Service Provider and the Customer (Client) who is also a Consumer shall be submitted to the competent courts in accordance with the provisions of the Code of Civil Procedure of November 17, 1964 (Journal of Laws No. 43, item 296 as amended).
4.2 Any disputes arising between the Service Provider and the Customer who is not also a Consumer shall be submitted to the competent court for the seat of the Service Provider.
(5) A Customer who is a Consumer shall also have the right to use out-of-court dispute resolution methods, in particular by submitting, after the complaint procedure, an application for mediation or an application for consideration of the case by an arbitration court (the application can be downloaded at http://www.uokik.gov.pl/download.php?plik=6223). The list of Permanent Arbitration Consumer Courts operating at Provincial Inspectorates of Trade Inspection is available at: http://www.uokik.gov.pl/wazne_adresy.php#faq596. A consumer may also use the free assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection. Out-of-court settlement of claims after the complaint procedure is free of charge.
